("Flyin'", "we", "us").
1.2 "Charterer" / "you" means the person or entity that accepts a Flyin' quotation, on its own behalf and on behalf of every passenger travelling under the booking.
1.3 "Operator" means the air carrier holding a valid Air Operator Certificate (AOC) and Operating Licence that performs the flight.
1.4 These Terms apply to every booking made with Flyin' by quotation, e-mail, telephone or through www.flyincharter.com. The version in force on the date you accept a quotation applies to that booking. Previous versions are available on request.
2.1 Flyin' is an air charter broker. We do not own or operate aircraft and we are not an air carrier.
2.2 When you accept a quotation, Flyin' acts as your agent, in your name and on your behalf, to arrange the charter of an aircraft with an Operator. The contract of carriage is concluded between you and the Operator.
2.3 The flight is operated under the Operator's AOC, under its sole operational control and responsibility, in accordance with Regulation (EU) No 965/2012, Regulation (EC) No 1008/2008 and the requirements of the Hellenic Civil Aviation Authority and EASA.
2.4 Flyin' only arranges charters with Operators that, at the time of booking, (a) hold a valid AOC and Operating Licence, (b) maintain insurance compliant with Regulation (EC) No 785/2004, and (c) are not subject to an operating ban under Regulation (EC) No 2111/2005 (EU Air Safety List).
3.1 The identity of the Operator will be stated in the booking confirmation, in accordance with Article 11 of Regulation (EC) No 2111/2005.
3.2 If the Operator changes after booking, we will inform you of the new Operator as soon as the change is known, and in any case at check-in or before boarding.
3.3 Aircraft images in quotations are representative. The aircraft type is confirmed; the specific aircraft registration may vary.
4.1 Quotations are subject to aircraft availability and Operator confirmation at the time of acceptance. Prices are valid for ten (10) days from the quotation date, unless stated otherwise.
4.2 A booking is confirmed only when (a) you have returned the signed acceptance of the selected option, (b) payment has been received in accordance with Clause 6, and (c) we have issued a written booking confirmation.
4.3 Flight times are estimates. Actual flight times depend on air traffic control, weather and operational conditions.
5.1 The charter price includes: aircraft operating and maintenance costs, crew, fuel, third-party and passenger liability insurance, landing, parking and navigation charges, and passenger and baggage handling at the airports/helipads stated in the quotation.
5.2 The airport modernisation and development fee (T.E.A.A.) and any other taxes or charges that are unavoidable and known at the time of quotation are included in, and itemised within, the Total Price.
5.3 Not included, and charged at cost only if they arise: costs caused by changes you request (Clause 8); waiting time beyond the time stated in the quotation; additional landings; de-icing; catering or special services you request; charges imposed by authorities after the date of quotation.
6.1 The full Total Price must be received before departure and in any case within the deadline stated in the booking confirmation. If payment is not received on time, the Operator may release the aircraft and the booking may be cancelled under Clause 9.
6.2 Bank transfer in EUR to:
Beneficiary: ERRA IKE
Address: Xanthippou 62, 15561 Cholargos, Greece
Bank: ALPHA BANK
BIC/SWIFT: CRBAGRAA
Bank charges are borne by the payer. Please send proof of payment quoting the booking reference.
6.3 Card payments: an additional fee of 4% applies to all credit and debit card payments. Bank transfers carry no additional fee.
6.4 Payments are received by ERRA IKE on your behalf for transmission to the Operator.
7.1 No later than forty-eight (48) hours before departure you must provide: full names of all passengers as shown in their travel documents; copies of passports/ID cards; passengers' actual body weight; number and weight of baggage; connecting flight details (if any); invoicing details.
7.2 You are responsible for every passenger holding valid travel documents, visas and health documents required for the journey.
7.3 Baggage must not exceed the limits stated in the quotation. The Operator and the pilot-in-command may refuse any item because of its size, shape, weight or nature. Dangerous goods are prohibited unless expressly accepted by the Operator.
7.4 Passengers must be at the departure point at least twenty (20) minutes before scheduled departure.
8.1 No change to the agreed route, schedule, passengers or aircraft may be made without the Operator's consent.
8.2 If the Operator consents to a change you request, you will pay any additional cost arising from it (e.g. fuel, positioning, crew duty, fees). We will confirm the cost to you in writing before the change is made.
9.1 Cancellation must be notified to us in writing. The following charges apply, calculated on the Total Price and counted from the scheduled departure time:
• More than 7 days before departure: 10%
• From 7 days to 72 hours before departure: 30%
• From 72 hours to 24 hours before departure: 70%
• Less than 24 hours before departure, or no-show: 100%
9.2 Where the Operator's own cancellation terms for the specific flight are stricter, those terms apply only if they were stated in the quotation or booking confirmation.
9.3 Amounts already paid are retained up to the applicable charge; any balance is refunded. If no payment has been made, the applicable charge is payable on demand.
10.1 If the flight cannot be performed because of weather, technical reasons, safety reasons, air traffic control, or restrictions imposed by authorities, you are entitled, at your choice, to (a) a full refund of the amount paid for the flight not performed, or (b) rescheduling at no additional charge, subject to availability.
10.2 If the aircraft becomes unserviceable, the Operator will use reasonable efforts to provide a replacement aircraft of the same or similar type. If you accept the replacement, the agreed price remains payable. If you decline it, or none is available, Clause 10.1(a) applies.
10.3 Your rights under Regulation (EC) No 261/2004 and other applicable EU passenger rights legislation, where these apply, are not affected and are owed by the Operator.
11.1 The pilot-in-command has final authority over all matters concerning the safety of the aircraft, passengers, crew and baggage, including: acceptance, refusal or disembarkation of passengers; loading and distribution of baggage; whether, when and by which route the flight is conducted; and where any intermediate or final landing is made.
11.2 A decision by the pilot-in-command on safety grounds does not constitute a breach of contract by the Operator or by Flyin'.
12.1 The Operator is solely liable for the carriage, including death or bodily injury of passengers, delay, and loss of or damage to baggage, in accordance with the Montreal Convention 1999, Regulation (EC) No 2027/97 as amended by Regulation (EC) No 889/2002, Regulation (EC) No 785/2004 and the Greek Air Code (Law 1815/1988), as applicable.
12.2 Flyin' is liable only for the proper performance of its own obligations as broker (selecting and booking an Operator meeting Clause 2.4, transmitting your instructions and payments, informing you of the Operator's identity).
12.3 To the extent permitted by law, Flyin's liability under Clause 12.2 is limited to the amount paid by you for the booking concerned, and excludes indirect or consequential loss and loss of profit.
12.4 Nothing in these Terms limits or excludes liability for intent or gross negligence (Article 332 of the Greek Civil Code), for death or personal injury caused by negligence, or any right a consumer has under mandatory law (including Law 2251/1994).
Neither Flyin' nor the Operator is liable for failure or delay in performance caused by events beyond their reasonable control, including adverse weather, natural events, strikes, war, terrorism, epidemics, acts or restrictions of authorities, and air traffic control restrictions. In such cases Clause 10.1 applies.
You and all passengers must comply with applicable aviation, security and customs law, the instructions of the crew and the Operator's safety rules. You are liable for damage caused by passengers to the aircraft or to third parties and for fines imposed because of passengers' conduct or missing documents.
Personal data of the Charterer and passengers are processed in accordance with Regulation (EU) 2016/679 (GDPR) and our Privacy Policy available at www.flyincharter.com/privacy.
You may not assign your rights and obligations under the booking to a third party without our prior written consent and the Operator's consent.
In accordance with Article 3(3)(k) of Directive 2011/83/EU, the 14-day right of withdrawal for distance contracts does not apply to passenger transport services. Cancellation is governed by Clause 9.
Complaints should be sent in writing to sales@flyincharter.com within thirty (30) days of the flight date. We will forward complaints concerning the carriage to the Operator and will reply within thirty (30) days. Consumers may also refer disputes to the Hellenic Consumer Ombudsman (Synigoros tou Katanaloti).
These Terms are governed by Greek law. The courts of Athens have exclusive jurisdiction. If you are a consumer, you also keep the protection of the mandatory rules of your country of habitual residence and may bring proceedings before the courts of your domicile.
If any provision of these Terms is held invalid, the remaining provisions remain in force. These Terms, the quotation and the booking confirmation form the entire agreement. In case of conflict, the booking confirmation prevails, then the quotation, then these Terms.
